What Counts as Income for VA Pension in 2026? The Counted and Excluded Lists

The VA pension income rule is one sentence long, and it is broader than most people expect. Under 38 CFR 3.271, "payments of any kind from any source shall be counted as income" in the 12-month period received, "unless specifically excluded." Everything counts until a specific exclusion says otherwise. If you are used to tax law, where income is defined by what is included, VA pension flips it: income is everything, minus a list.

That framing explains most of the surprises. Social Security, military retired pay, civilian pensions, wages, interest and dividends, rental income, annuities, and one-time payments like an inheritance are all counted. VA's own rates page names Social Security, investment and retirement payments, and dependents' income explicitly. An inheritance is counted for the 12 months after you receive it, and it also lands in your net worth, which has a 2026 limit of $163,699.

There is no separate income limit to trip over. Your countable income has to sit below the Maximum Annual Pension Rate for your category, and VA pays the difference. Income above your MAPR means a payment of zero until deductions bring it back under the cap. That is the whole calculation, which makes knowing what counts the entire game.

What does not count: the 38 CFR 3.272 exclusions

The exclusion list is where the rule gets interesting, and it is shorter than most applicants hope:

Two of these trip people up. First, the medical expense exclusion is usually the biggest lever: our piece on the 5% rule shows how $24,000 in care costs can take countable income to zero. Second, the property sale exclusion has a catch. The profit is excluded from income, but the sale proceeds become an asset in your net worth unless you buy another residence in the same calendar year. Sell the house and pocket the money, and the income exclusion will not save the net-worth test.

The waived-income trap. Income you could claim but waive still counts. Declining a Social Security check, refusing a pension payment, or asking an employer to hold your pay does not lower countable income. You cannot gift your way under the cap by turning money away.

My strong advice, and it is the least interesting advice in this piece: report everything and let VA apply the exclusions. The regulation deliberately does not name which welfare or charity programs qualify, so self-filtering is how people under-report and get hit later. VA's own guidance amounts to the same thing: report every payment, and the exclusion list does its work on their end.
